    If someone was planning to buy the domain, then that would be the perfect question to ask their lawyer before laying down any money for it.
    My "guess" would be, that the lawyer would make a decision based on what the prospective buyers intentions were for the domain.

    All I know is that Volkswagen AG acquired the Bugatti brand in 1998 (along with Bentley, Lamborghini, and Rolls-Royce).
