Basically I have been given a street warning and the policeman who gave it to me told me it wouldnt go on my permanent record, but I'm sceptical so I was just wondering if a Street Warning does appear in background/criminal record checks because I'm worried it may affect me while applying for uni/ my career. Thanks
JAC92: If you're talking about a "street warning" in the UK, you might have a record in the local department's computer system, but nothing should come up in any sort of national background check because it's not a criminal conviction. They usually do this so that if you're caught again doing whatever it is you did, they know they've warned you before and might be more inclined to charge you. Then you risk getting a criminal record, if convicted. Andrew: To answer your question, I believe this is analogous to a "contact-card" in Canada. I'm not sure what it's called in the USA, but I think I have read somewhere that the Chicago police refer to it as a contact card as well. It seems to be an internal records keeping system set up by police departments to track people who the police question regardless of whether they are ultimately charged with an offence.
you have to trust they are being honest with you. And that they have created a system that functions according to the rules. Otherwise, expect it to show.
Typically, in the US, only criminal conviction records disposed in a court will be released as public record. A warning in itself is not considered a violation and would not be released. You can always check your record by utilizing an online criminal background check site or by personally contacting the county court clerk’s office for any records on file.
As far as I am aware, in the UK it is only an offence to give false details when at a police station. If you are stopped in the street and you give false details, there is nothing they can do. Its only an offence once you'e down the cop shop.
My bad - I appear to have misunderstood the article I was reading the other day - here: bbc.co.uk/news/10326643 If you are arrested or under caution you must at all times give correct information. If a mod wishes to delete my posts it would probably be for the best.
