I own a very successful site. It's domain ends in .net. The .com version was taken when I went to register it, so I bought the .net version instead. Fast forward a few years and .net has taken off and brings in plenty of money monthly. Do I have any legal leg to stand on to acquire the .com version? The .com page is your generic search/cybersquatting page. When I spoke to the .com owner awhile ago, he mentioned he would only sell for the high 5 figures. Is this my only option?
I guess that if he got the domain before you bought yours, you do not have anything to say. The only way is to buy it from him.
You have no right to the domain as it was registered before you (so it was not a "bad faith" registration), and is not infringing upon your usage. Your only option would be to buy it from the owner or pick it up in the unlikely event they let the registration expire.
I think he is charging you way too much. Try to negotiate it down to less than $1000, and if he doesn't budge, I'd say forget about the domain, it's not worth it.
Yes I agree and the other two options you have are to continue with the .NET or to buy another .com and 301 to the new .com.

WRONG. You don't need to trademark a name to have trademark rights. A trademark doesn't give you exclusive rights to a name, rather a particular usage. The other domain was registered BEFORE the other site and the usage is not infringing. That means no trademark infringement.
