Guys this is very serious question, so please listen carefully and tell me what should i do. My website,video sharing website, HankerTube dot com is active since 6 months and spent lots of money around £1000 on the layout of the page, which is similar to YouTube, and yet not exactly is copywrited to YouTube, based on scripting and features. Recently i wanted to advertise my website on Google Adwords, and my ad for the very first was refused! You Know why, this is what they said: Ad Status: Disapproved Ad Issue(s): Copyright ~~~~~~~~~SUGGESTIONS: Ad Content: It has come to our attention that your ad promotes the copying or distribution of copyrighted material without the consent of the copyright holder. --------------------- POLICY DEFINITIONS: Copyright: Copyright Infringement: Copyrights are important business assets in which the copyright holder maintains exclusive rights. I understand that some videos are embeded and played on our website, and yet they have YouTube's logo, is this still copywright? Or please tell me if i have to add some text on the bottom of the website, that we are not responsible for the content of any video being posted or uploaded on our website, or if requested by the users we will just delete them...
Any content on your website which is not yours is in effect copyright infringement. Videos, photos are most often copied illegally. You must know where you have your content from.
Remove all videos that were not loaded by the author... and try again. Apply with the copyright.gov office as a Designated Agent of DMCA and following their guidelines.
Google's TOS for AdWords are more restrictive than just whether you are a contributory infringer. Adding text on the bottom of the website to the effect that the website is not responsible for the content of any video being posted or uploaded to the website, or that you will delete materials if requested by the copyright holder, will probably NOT satisfy Google if it appears that your site promotes (or even tolerate) the copying or distribution of copyrighted material without the consent of the copyright holder. Also, the notice you received from Google referred to your ad, not your website. Although that may just be Google's boilerplate response, have you carefully looked at the wording of your ad to make sure it does not appear to promote uploading copyrighted material without the consent of the copyright holder?
