I don't see how it's either. what the difference if I as a small business file suit to stop you from using my content or if a big business does it?
It's not "flexing muscle" it's protecting your copyright and trademark.
    What's so harsh about it?
It's only harsh to people breaking the law...but then again anything is harsh if you get caught..doesn't matter if it's stealing movies or or stealing my wallet...even if you found my wallet laying on a public street, you still know that taking the money and using my credit cards is illegal..to bad we have to pass constant legislation to tell tell people what they already know.
If it's nt yours or you don't have permission, you can't take it.
We all learned that as children. No big secrets.

Do you know the penalties for copyright violation? Do you know the penalties for other crimes? How are they set? Do you know what corporate lobbying is. It's not that simple, unfortunately. Here is some good reading material:

    http://en.wikipedia.org/wiki/Copyright_Term_Extension_Act

    http://www.boston.com/news/local/ma...ent_fined_675000_for_illegal_music_downloads/

Tenenbaum could have been ordered to pay as much as $150,000 for each song, or a total of $4.5 million, because the jury concluded that the infringements were “willful.’’ Under federal law, the jury had to award at least $750 for each infringement.

You may ask yourself why penalties are this harsh for statutory damages. What happens if you don't pay a small claims judgment, which many people just blow off? Aren't there hundreds of thousands, probably millions of wrongdoers who simply don't pay judgments because enforcement costs too much for the rightful plaintiff? Why aren't there significant, harsh penalties for blowing off the court and the payment of what you've wrongfully taken?

So the real question is which is a bigger problem for society and which is a bigger problem for wealthy private interests? There is much going on than just black and white... not stating for a minute that the original conduct is justified but there is a bigger picture here...
