i know that it is illegal to download music that you dont have the copyrights for, ie torrenting albums etc etc but when you find it in a web host, what is it they allow which allows you to do so? is it warez linking? only i want a offshore server that allows warez and warez linking if that is what it is.
There are offshore hosts which do not have the liability like they do in the US and other places. That just means they aren't likely to be held responsible. Depending on where you live, the site owner can be held liable, so finding a host that allows it does not mean you have no legal exposure. Even linking can be deemed contributory infringement. You should consult with a local IP attorney to determine your legal exposure.
Hard to do it from within the Uk. You'd have to probably move to a whole new country where the laws deem it legal.
thanks for the information, i'll still do the site anyway as it will generate income, so im looking for a host that allows warez on their customers sites.
I would advise you not to carry out the site, please read: http://www.guardian.co.uk/music/musicblog/2009/jul/27/filesharing-music-industry
surley, if i dont supply the actuall music and get website viewers to provide the content, im not liable for stealing, making me for of a warez website, if you get me. but theres people on here that supply people with free family guy series etc, there shouldnt be any difference with music?
Just because you don't supply the actual music does not mean you are not liable. To the extent that your site enables people to infringe someone's copyrighted materials, you are a contributory infringer. You're right on one thing - there should not be any difference whether the copyrighted material is music or a television series. There isn't. The fact that there are websites which illegally supply video downloads of "Family Guy" doesn't make it OK to do so. They are infringing the owner's copyright just as the sites that facilitate the download of music are violating the copyright.
its a risk i both want to take, but also dont want to take :/ my site would never really be big enough to even be found out? theres plenty of warez sites out there that havent been sued such as warez-**.org ?
Look, you've gotten legal advice. If you go through with the site, you are at risk, period. Most of the times it depends on the actual copyright owner and how aggressive they are - or will be in the future. Forget about the domain TLD, it doesn't matter. Forget about what other people are doing, it doesn't matter and isn't a legal defense. The larger the site, the bigger the risk - but there are companies that specialize in providing services to copyright holders and they will find anything that anyone else can find. If you want to take the risk about trying to make money off of property own by someone else don't come back crying if you get sued. Perhaps you should try an find a way to make money using an original idea that doesn't require theft of someone else's property.
yeah, i have a LLLL.NET domain, but because there is no site its said to be worth on registration fee's :/ , its name was BestFreeMusicDownloads.net but what can i change it too to make money from it?
There are a lot of artists that allow their music to be downloaded for free. Linking to them isn't going to be a problem.
