Well "/custom/" is the theme directory, where the images and stylesheet are, so I'd say it's a custom design, you cannot use this theme without stealing it. Your next topic had better not be titled "How do I steal a wordpress theme off a website?" xD

Neither of those sites use Wordpress. The first one uses a CMS called YellowHawk, and the second one looks like custom job. To find out what theme a Wordpress site is using, view the source code and find the CSS stylesheet. It will often have the name of the theme and its author.
Ya, Cash Nebula is right. Neither of the sites use Wordpress. But if you want to know whether a site uses WP or not then not by the CSS, always use typing the url /wp-admin/ after that site's url. It should show up the default WP login form, otherwise it will give 404 error, page not found.
You could hire someone to recreate the theme in Wordpress for you. There are plenty of cheap and talented designers out there.

You could... Learn to program html/css... and then, make your own theme? I understand you not wanting to if you are only a blogger. But if you're going to be doing any sort of web development... You will cut your overhead drastically if you can generate your own graphics and websites... or cms skins, at least.
