I am not sure what do you mean, however, if they charged you some amount and it is against their TOS, you can ask your credit card company to make a chargeback.

What files do you want back that warrants a $40 fee?

Ouch, sorry for the bad luck at that host. This is why I tend to choose the big names; hostgator, godaddy, etc

Even I faced the same issue(for Using RS leech which I never did) in Dec 2009 with that bloody my 365host and now I am using another host which is really really cheap and stable

Definitely My365host is a SCAM I suggest not to use MY365host

First, before accusing My365Host for being a "scam", please look up the definition of "scam".
Both of you were suspended for Violation of Terms that you agree to upon ordering web hosting from My365Host.
There is a ZERO Tolerance Policy for scripts such as RapidLeech. Why? Because they are scripts that highly consume resources such as bandwidth + cpu.
No matter who uploaded / used the script on to your account(s), you as the client are responsible for anything done under your account.
Unless you can provide proof that your account was "hacked", which both were not (as we provided proof); we charge Administrative Fees.

Also @ zeekapitein you violated our terms twice, and tried hiding the scripts by changing the directories, + we provided proof that it was you. You were warned, and then charged the fee. (We even gave you a second chance by allowing you to stay with us, and not switch hosts; even though usually we ask clients who violate our terms to leave!) Not only that, You even threatened that you would post fake and negative comments about My365Host if we did not agree to your demands!

So no, My365Host is not a "scam" nor have we ever "scammed" anyone.

I will now report this thread to be closed by the mods; and we can provide any proof needed.
