I have a small website that has many megaupload links for anime. Recently, an american company Funimation has been going around sending DMCA notices to websites to remove certain animes. So anyway, Our members & I dont want to be bothered by DMCA's. Are there any hosts that are outside the jurisdiction of DMCA, and don't have to comply with it? Typically which countries should I be looking for a new webhost from?

Mmhh... dutch? If i recall faytear.blogspot also have the same issue a long time ago and he move the hosting to other country. But i forgot which one. Should look for country that support a lot of freedom ;p
YEAH! Because the Chinese is sooo freedom loving... Probably the worst suggestion today, unless you were ironic. To OP: What you are doing is a form of stealing, no matter how much "non-for-profit" you calim or show. These companies want to own their own content and traffic and consider everything else a violation of their property rights. To not want ot be "bothered" by DMCA's is a faul argument and will not get you very far. There are shady companies around with higher tolerance for DMCA's, but they will just start going after your domain and stuff instead and they will hunt you down. Play fair and by the rules, it will benefit you in the long run.
any host outside of U.S.A is not bound to DMCA , DMCA is American act . in personal opinion get a a host from .nl or Spain where it is perfectly legit to share copy righted material when not making any profits off it.
Go offshore HK or China, also post that your links are for archival purposes only, and you do not host them. Also register under alternative credentials. Cheers, Bruce
I wonder if these companies realise how many more fans they gain through people viewing their shows "illegally" on the net.
Many are aware and many don't care as long as ads are still in the show as that gives them free advertising it is when the ads are cut out and they have nothing left to offer their ad clientele that they are unhappy because fans dont make money by just watching a show.
Even if the host company is outside the clutches of DMCA, that doesn't spare their customers from DMCA. Since the host company is not breaking any laws, it is in terms that you are legally responsible for the content you put up - so you are liable not the host company. The host seller sells you their hosting space for good use, not for unfair use, read the ToS carefully. If you really want to avoid DMCA notices, try to put it like this: download link .[shortened with bit.ly]. via .[original posting website name]. So it will appear that someone else violated the laws and you just mentioned it. Like this, you may not get DMCA notice, but copyright owners can still request you to take down those illegal download links. If you shorten them with bit.ly sort of services, it will take longer to find out.
The offshore servers which are available till now are from Netherlands and Germany countries and they are probably the best to go with to avoid DMCA complaints.
Yes you can only link to warez not supply it on your server. Mostly everything is legal offshore excluding childporn and warez hosting. Netherlands and China are great locations to get hosts in my opinion and as said before.
