I would like to open that kind of site , and i would like to know if this is a legal site. Thanks a lot.
I just looked at the tubezen site and I believe the owners have a problem. They are providing the means to violate copyright law which makes them open to a lawsuit as contributory infringers. ______________ Andrew Jaffe Attorney at Law 330-666-5026 netlaws.us
But there are a lot of sites and softwares like that , they are legal as far as i know .. (youtube dowbnoaders sites and softwares...) , what is the difference here?
I think they are , i see a lot of ads on google adsense(Youtube softwares) , and with my experience google adsense ban on ilegal stuff right away ... (google blocked 2 of my sites within 2 days after i opened them , today those sites closed but it is jusr an example).
I don't know for sure if it's violating copyright law (I believe it is, but IANAL), but it is definitely violating the Adsense program policies. Google explicitly forbids the placement of Adsense ads on sites that assist in the download of streaming videos (like YouTube).
How will you explain that this program is advertised on google adsense? http://apps.flowmix.net/ytdnld/?CC=ALL&prd=ytdn&kw=youtube save&adty=b728x90 You can see the ads on tubezen.com site ... (And i see that kind of ads for a long time on google adwords) Anyway , i`ll go to a laywer to get more info about this issue.
Adwords allows ads to run for sites that violate the terms of other Google services - whether that's by accident or design, I don't know. If Adsense determines that a site is violating Adsense policies, that account will be disabled, no matter whether it was advertised via Adwords or not.
If you have a team of lawyers to defend your site go for it. When youtube was the 'new thing' it made the news frequently that is was being sued. I googled youtuve lawsuits and found this article. http://newteevee.com/2008/08/06/youtube-lawsuits-a-roundup/
WOW. I really wonder how they keep up with those lawsuits - and how their still online and operating today.
I think they are covered under the agreement users agree to, to not upload copyrighted material. IF Youtube did not moderate they could be sued for distribution, but as long as they show that they are on top of deleting copyrighted content and banning the users I would guess the cases would be won in their favor. Still does not null all the lawyer fees though.
