I have my own site and i need whether i can upload Film songs and allow peoples to download the songs freely? Is there is any copywrite issues is there? I found many sites are doing likethis is this is legally correct.

No it is not legal to do this. Just because one person steals something does it make it right for you to steal something as well?
What I don't like about threads like this is too many people just chime in saying the sky is falling if you do. They know nothing about you or your site. If you have a page that users must agree to not upload any copyrighted content, you may be okay. Stop screaming, I said "maybe." Youtube has this and courts have already decided it is not up to youtube to remove the content unless asked. If you are asked, you must remove it. But I'm sure all songs users upload are probably copyrighted. You would not be asking this unless they were. Obviously, you have set up a site specifically for uploading copyrighted material. You probably will be shot down. If you had generic upload site, maybe not. If your host gets word that you are allowing copyrighted material, they probably will turn you off in a heart beat. songs are copyrighted, so you will have to remove any content which will be reuired then hosting provider might also close your site so it is important where to host
Oww goodie a topic i know all about. 1. You cannot upload music to your site for people to download that is under copyright and or non-creative commons license. 2. You can be fined up to millions of dollars per copyrighted song violation and your site could be shut down by RIAA or other agencies 3. IF you ever get a DMCA Request to take down a file or whatever you should respond to that asap 4. Music is licensed by the copyright holders it would be wise for you to have the composer upload the song or file 5. IF you are uploading creative commons license songs you are in full legal compliance since they are free legal music. 6. always check the songs you upload for copyright there is a few websites that check status on song names or artist names.
Basically if you do not own the copyright or have the copyright holder's permissions, then it is against the law for you to host it on your website.
Would your site be useful without the illegitimate copyrighted content? If yes then just put the warning in your 'terms of use' and 'copyright policy'. If the answer is no then you are building something that is by design illegal.
well, people can upload copyrighted material to youtube can't they? so, as long as you remove the songs that companies complain for i guess you are not liable, if you have a nice TOS
The copyright owner can yes, if you dont own the copright then NO. Why do you think that you find something one day and the next you get a notice that it has been removed? Also why do something you know is illegal in the first palce? Its like saying its ok to shop lift as long as you dont get caught. We all know its NOT ok even though people do do it. Eventually they will get caught, and be prosecuted.
You what I hate about threads like this is too many people chiming in and giving bad advice by comparing a Billion Dollar Company with an entire building full of lawyers on salary to a small webmaster with a single website who (obviously) does not have legal representation or training or else he wouldn't be asking here. I don't care what You Tube does..you can't do it. When you become You Tube or bigger, then you can play with a few legal issues because you have a staff that can spend 40 hrs a week in court...because that's their job.
I suppose anybody can indeed do anything thing want until they get shut down. So the point is? We don't run other people's sites and have no control over them. We do not know what a court will rule. We don't know anything about the person, the site, or anything else. We can make "judgements" on the surface, but they don't matter. I keep bringing up OJ. Slam dunk case. How'd that work out? lolz by this post you mean to tell me or rather reconfirm what i already know that laws regarding copy rights are out dated and made to suit the rich media and entertainment companies and they don't dare to go after youtube cause they know once they do it's all out battle with a more then powerful company then the whole of MAPAA combined !!! and that they are going to be most likely be eating the dirt [ which btw is going to happen once DEB in U.K comes into force] , in case you have not noticed there is whole wide world out side u.s.a and most of the 'advice' given here just comes from states side 'legal' experts pun intended . @ op it all depends on where you live and where your hosting is . it is perfectly fine to upload and share copy righted material in some countries like Spain and .nl if not for personal gain ! or if you are not profiting off it. look around at D.C's which allow it according to laws of their country . and some d.c's in east Asia and Ukraine really don't care what you do. so use some common sense and google things up
