WOW...just advice thats all, just dont park the domain because you are bound to find Joomla ads appearing. That benefitting financially from a TM

At the end of the day, its up to you what you do with the name...good luck

Thats doesnt matter at all "Joomla" is trademarked, thats all that matters, check out the legal section and you will see, you cant have 3DMicrosoft.com or 3DOlympics.com, it violating a TM, there are some good "internet/domain" lawyers on Namepros that will tell you this.

Yes you could, the reason you could is that there would be no confusion between McDonald's the fast food company and McDonald's the shoe company. Also, McDonald is a common family name and has been around a lot longer than the fast food company.
On the other hand, if you started a burger bar/restaurant and called it McDonald's, you would end up wishing you had started a shoe shop.

Yep, and while their still aloud to sell blank dvd's, it must be OK to copy movies.
While they still sell matches, it must be OK to burn down houses.
Because they still make cars that can go real fast, it must be OK to break the speed limit.
While their still allowed to sell guns, it must be OK to shoot people....
    etc, etc, etc, etc

They sort of did, by protecting it with a trademark.

So if I bought a domain from you, then used it to break the law. Would you take the rap?
    --------------

On another note, I have added a few more to my collection over the last few weeks, but can't remember which transactions are completed and which aren't... The ones I'm positive I got are... 3Dbeta.com, 3Dalt.com, 3DgamingPC(s).com and 3dMovieScreens.com.

    Cheers
    James

Be serious though, what else were you planning on using the word Joomla for, a shoe company?? home made-candles?? designers watches? I seriously doubt that

Anyway, these are just my opinions, you are free to do what you want

Yep, i bought a few domain names which would def be TM. should've read forums before starting domaining, 3DHarryPotter.com , 3DStarTrek.com etc. Have em on Sedo, never know...studios might buy them...or should i just point them to charity donation site or something. Suggestions anyone?

Just delete them from your account, thats the easiest, if not, dont park them and just let them expire

Really against any TM & autor rights: if you wanted to protect your name 1. You would have allready bought the name 2. Would hide in a hole with you compgny's banner...
If you are public = intellectual property doesn't exist anymore. The only place that your intellectual property exist is in your personal diary!

Ps: Really think that dominers(not only you giles) really are too dramatical with TM: why on earth Blu-ray.com exist? The same site has maybe 50-100 diffrent way to say Blu-ray or 3Dblu-ray and he's still there! It's not because 1-5 dumb ass compagny is crazy of it's trade mark that everyone else is wako.

The point I want to make is that don't register domain names with the intention of registering the TM.

ps: I reg for 100$ of domain names with a new tech that I did the research for TM, but after a week I found out that it was trademarked in UK. If they TM in Ouganda: how the hell should I know!

Experienced dominers dont like people who register TM names because it gives all domainers the tag "Cybersquatters" which most domainers arent.

Just think if someone was benefitting financially from your company after putting in years of hard work

Thye are dramatical to try and warn others, just read the legal section to see how many people have trouble becasue of it, its just not worth it, thats all.

PS: Just because there are 1000's of sites out there that infringe on a TM and arent being caught or sent a C&D letter, doesnt make it right or ethical.

100% behind your text., but there's a difference between TM of Nike & Blu-ray. Bluray is a product name & Nike (or the exemple of FIFA) is only a brand. Lots of domainers don't understand this point and are scaring young domainers. If I reg a couple of 3DBluray... domains I'm not a squatter! It's the same thing as the people who reg DVD.com: it's a disc format, but the name is TM.

The problem is that compagnies are TM products instead of it's brand. In that case, why would they bug you If your selling they're products for they're profit?

The main difference between your exemples & registering an TM domain name is: that at the moment you reg the domain -- if it's a TM one -- you are doing something illegal. The right exemple would be: selling guns to someone that has mental illness & saying in front of the gunshop clerk: I'm gonna use it tonight to kill my wife & kids. So, they are accepting your money even if it's an illegal purchase(at the exact moment of the transaction--not after!): so they are responsible, like the owner of the domain of the TM bypass. If they say: we didn't know: you can say the samething!

TM are bullshit & those who defend this principal are wakos ! It's the samething as poor people against universal healthcare & defending the opposition (probably the most stupidest & akward way to think in all human history!): know your interrests for God sake (oups God sake is trademark!)!

You can tell us the consequences(ok!), but defend the TM's is (in my opinion) really(R-E-A-L-L-Y) dumb(nothing personal Tattoo!)

It would only be illegal if you brought the domain with the intention of infringing on someones TM. For instance, if Bill McDonald of outback Nevada registered McDonalds.com to host a site about his family tree, that would be fine.
If he brought the domain and tried to make money off it by selling similar products as a famous company with the same name, or started a business on the domain in the same category as the famous company, then he would be infringing on the TM. But, it would still take a court to decide. (trademark lawsuits aren't always successful)

No, those that defend them are usually the owners of the TM (and their lawyers). But I agree, some are wakos

I don't have any trademarks to defend.

But, if I had built up a company, branded and trademarked its name (As an example, Dell.com), spent big $$$ advertising and promoting the brand so it became a household name. Do you think it would be OK for someone to buy dellcomputers.com and start selling computers on it? computers that were not made by Dell? or even their competitions computers? Don't you think that Dell should have a right to protect their brand?
What if someone started selling really cheap crappy computers on there and the people buying them started telling all there friends that Dell made crap computers... Don't you think Dell should be able to protect the money they invested in R&D, branding, advertising etc?

I think 3D is a fad, I could never see my self sitting around my living room watching a 3d game or movie, I even have a movie theater in my house and have no interest in ever making it a 3d theater. But what do I know, I still think facebook is stupid.
