i had a car accident, and the other guy doesnt have car insurance

will he go to jail ? i hope he does, cuz he ran thru the red traffic light and struck into my car, and my car was totalled

p.s. he doesnt have insurance cuz his insurance is expired

 

He won't go to jail but he'll have to pay for damages out of pocket.

He will have to pay for your damages take him to small claims court and contact your insurance company.

 

I hope you don't live in Australia. I've seen that happened plenty of times and the cops did nothing about it.

 

That sucks. :/ Honestly there's not much you can do about it, I hope your insurance covers it.

 

i already filed in the small claim court..but i dontk now how much i can claim back, the maximum is small claim court is $5000, but my car totalled......

 

I think you could also file under the uninsured motorist fund. You might want to check that out. As for him, I think he should get jail time for pure negligience. It is against the law to drive uninsured

The only thing you can do is sue him in civil court.

 

He should pay for the damages. I dont know which country your from, but I doubt he will go to jail since no one died or was seriously injured.
You can sue him for civil liability, but I dont know what your court system is like.
