That's the downside of unlimited hosting. There are so many restrictions. If you haven't read their TOS and there is something in their TOS that states that your site can't be of a certain size then you can't do much. Your best bet would be to see if you can get a backup and move on to another host. And perhaps this time, you go with a host that limits your usage so you know how much you can use.

I don't see why they have no reason to give you your files back.

If I suspend a client its alway best practice to give the client a latest backup of there account. Even if it involves unsuspending there account.

The only way I see most hosts not giving you your files back is if you never paid your bill.

Dreamhost had suspended my account and refused to let me backup my files... but it was for some other reason.

All you can do is appeal to them. There is nothing much that can be done...

They must inform you in advance and suspend your account. I don't see a reason why they hold your files and information. For any web site Files and DB is so important. If you have paid money through any of the merchant service, You can complaint through them.

This will have impact on their business channel and they will work out a solution to take your file backup.

You can try to request them to open the account for 24 hours and give you jailed shell access so that you can manually backup the site for yourself. If they refuse to give ssh access, try to get 48 hours from them and manually download all the files.

Try to convince them somehow, and if they still don't agree. Pay them a nominal fee for taking backup of your sites.
