Writing a Disclaimer

    I'm starting a fansite/blog related to the popular Facebook game, Farmville, and I'll be using pictures from the Farmville game so I believe it's a good idea to have a disclaimer on my blog. What should I cover in the disclaimer and what's the appropriate way to write a disclaimer to disassociate myself from Zynga (the company that created Farmville) and not run into any trouble?

    You'll likely need permission to use their images - a disclaimer doesn't grant you permission. Now if your site is a pure fan site with no monetization (doesn't run adsense or other types of advertising, no membership fee, no donations, etc) fair use might apply - but vast sums of money has been spent arguing this and I would get permission to avoid any problems.

    Hmm okay. Yeah I thought a disclaimer would do, but I'll ask them for permission as well.

    You normally have to do both ask permission and write a disclamer to suggest your not making money from their copyrighted content.

    copy right and trademark are two separate issues.. you can visit my website "copyright & trademark" notice section for the disclaimer.. basically you disclaim the appearance of endorsement..

    He does not need to write a disclaimer or anything after the permission.
