Hi Everyone, I sell guest posts in my blogs and I found that one of my clients has put up blog posts promoting a site which sells Rolex replica watches. Will I have any legal issues because of this considering the fact that it is not me who has put up the content in the blogs.
Very dodgy area, only things I can find basically say: It is if its using brand logos. It's trademark infringement. They can be made and sold, but if they use the logo etc then very bad :S If they promote and dont sell then you should be ok, but I dont think anything would happen, but if you want to be safe then you can just remove it
It is unlikely that the authorities would go after someone promoting counterfeit merchandise. However if the supplier is taken down, it is possible that certain affiliates could go down with them. It is more likely that, if anything, Rolex would come after you. Although you'll have to research if they have taken such actions against an advertiser/affiliate. I personally would pull the guest blog post. It's on your site, so it's kind of your butt that's on the line. This just isn't worth the hassle. Tell them to stick with legit products next time. You never know what they might post next.
Yea, exactly my thoughts. The illegal part comes into play when the replica factor is not mentioned. As long as buyers are aware, then I wouldn't think there would be any legal implications behind it. Not only that, but I don't think you having the content on your blog is really hurting anyone either.
i don't think so,but you may have issues with your host or ad network if they don't allow selling of replicas.
my associate sold them for three years and was ranked quite high , site had easy contact page ,he never heard a word , I think there are just too many to police ,also they are two totally different markets (obviously)
