Well, our company has been scammed. It's not a whole lot of money, but enough to make our accounting dep. more than angry. It's approximately $2,500 USD and the "company" in China who scammed us has now almost gone under ground. They are still active, but changed their contact information and product information. Is there any way to make legal action against them?
How did you pay? If CC - do a chargeback - product/service not delivered If PayPal - put in a dispute - product/service not delivered I'm sure others will have additional alternatives but if cash, check, money order, wire transfer etc. you're only recourse is hiring an attorney in China to go after them there. It could be a tax writeoff if nothing else and chalking it up to lessons learned... is still invaluable learning.
Sorry. I think that falls under the lesson well learned. If their site is hosted in the US you may be able to cause them some grief but otherwise just pay them back where you can, but flaming and naming them here will only cause you problems with the mods, so don't do it here.
In all honesty, you can try to take legal action against them but that sounds like it would be a horrible business decision. The amount lost is only $2500. You would have to pay a lawyer, costs, and that just for a chance to win. But let's assume you win, and that it costs you nothing. Now you have a piece of paper saying that this company owes you money - now what? You still have nothing. Do you think you will be able to collect a judgment against this company even if you win? Sounds like a lot more wasted time and money for nothing to me.
what is scammed about? , good or services? ...$2,500 is big enough. If i be you i will kill him, use anything (kill his site, make his site can't open forever, kill his boss , cheap one use vodoo black magic ) . I am not sure about "lawyer" here, do you know the man who cheat you?, can you find him?, i am agree with browntwn , you will need more money ,,,huge money.
I have heard of bank wires being reversed, but I don't know much about it. You may want to look into that. Although they have probably taken the cash out already. Depends if the OP's country would extradite to China. lol
While I understand your frustrations, do keep illegal options off the forum. China legal system is quite different from democratic countries. It will take a lot of understanding to know how it works. Best is to get a local lawyer in China. But frankly speaking, the efforts may cost far more than the $2500.
some days back I was dealing with a company from china they were selling me an electronic product at a very discounted and cheap prices. I smelled a rat and I cancelled the deal. weeks later I saw reports on the internet about their company scammed many others..... OMG !
Contact their hosting providers (Whois the domain to find the hosting provider) regarding this issue and maybe they could take some action.
Thanks for all the advices and tips, I don't think we will take a law suit against them, and definetely not kill anyone, but I guess we will claim it as a loss on our taxes.
This must be a lesson for all other forum members as well. We need to make sure that all the transactions are made direct bank to bank and not through any other methods.
