Hi, I have a question. Is it against the DMCA to provide gaming hack programs. I can't see how it is as no copyrighted material is being used and the programs are coded by someone other than the company. Advice on this would be great thanks.
DMCA has nothing to do with the legal or illegal nature of your actions. DMCA ONLY aligns the unique nature of digital media to the rigid 500-year-old nature of print so that "COPYRIGHT LAW" didn't need to be rewritten. As for hacks - I would GUESS that these would be based on individual Term of Service for each individual product (as to whether you are violating your agreement that you acknowledged when initializing your user-account).
Try researching the case of Blizzard v. WOW Glider, this might answer some of your questions as it is a landmark case of developers versus people who reverse engineered their game. http:// news. bbc.co.uk/2/hi/technology/7645059.stm I can't post links yet, had to add spaces to that one.
Hacks... it's all dependent upon the level of detail. If you've done it without reverse engineering, I doubt even Blizzard could win... but that is an interesting looking case.
Thanks everyone for your help. I am trying to clear this up for a client. The programs he is developing are reverse engineering the software but the content is hosted on a German server while he remains in US. Any ideas?
German server eh? The German's have come down hard recently over "hacking" software. Might want to look into that.
Its simple. Its just stealing, now your just looking for approval on something you know is to be wrong....
Interesting topic - you rememer the guy on the news last week who claims to have cracked the PS3 and is able to play pirate games? Don't see him in jail yet! He's probably got a high flying job at Sony!!!!
