Yes, you can get banned if someone does this to you. you can do following to safe guard your self. 1. Ban his IP (if you know) in you Adsense Account. 2. Write an email to google, and explain this to them.

I do not think so. If that is the case shoemoney, problogger,digg , plenty of fish all these people should have got banned already since there may be so many jealous guys around. This philosophy is not right.
