Is it legal to make site like Dl4all in india ?

Hi Dp Experts,I want to ask some question before making a site,
I just wanna ask is it legal to make websites like Dl4all.com in india, both domain and hosting will be in india itself.Since the site is like anyone can post and share the stuffs by registering on it.
The admin of DL4all.com had a disclaimer at its bottom of the page,

Will doing like this will prevent me from indian police since it is clearly stated in disclaimer that whatever is being posted is from its users itself.
I will also allow only to share files via file-uploading services,though i will share some indian music also.....Plz help ang give your valuable suggestions.

 

I don't know about indian law, but, I assume it's close to US law. That disclaimer really won't help out if a company decided to sue DL4all. The administrators of websites are still responsible for what is posted on their website.

In India, you can sue this site. Adding Disclaimer doesn't mean you are safe. Go to court and file a suite.
Action will be taken.

 

What more do you need besides contact a lawyer? If you're not willing ot talk to a lawyer about a site you want to set up, then don't set it up, as you're eventually going to end up in trouble.

 

Check with an attorney. Disclaimer won't help. your still responsible for whats happening in there. however the members also would be responsible, not just you alone..

however if you keep a eye on everything you could get things to work, but which sounds real crazy as the number of users will be alarmingly high for sure

 

in India, such sites are illegal, even using them to download files is illegal.

if u use offshore hosting to country where cyber law is not yet formed or it is not illegal to host warez then u can run such site. ofcourse u will be sued if cyber law authorities trace u as owner of the site.

so my recomendation, don't even think of starting pirated movies, warez or porno site else u will get in trouble.

Friend No Problem. Just host that website in servers other than india. Simple.

Because if you are using own servers, there may be problem, but use shared or dedicated in some hostings which accept those.

Simple.

Even if they banned your site, just you loose data and hosting. But no way of police case. There are 100's of wareforumz and some are from india.

 

The people who make these kind of threads are typically looking for the one response that tells them it's safe, and that of course is deemed to be the correct one even if a dozen people say don't do it. lol

Yes, Indian Law might be different compared to US and its always better to have a clear idea before what you do and how you can complete the task using what all resources. Its also that you could consult a Lawyer and ask him about what rules needed to be followed to do this.

 

i live in India and have law degree and i can assure u such sites are 100% illegal in Indian cyber law. even if u r hosting on some other country then also u r accessing the site & uploading or downloading warez which is not legal.

the law says if u r caugt using/sharing warez pirated stuff then for first time u can be fined upto Rs. 5 lac, or 2 years prision or both for second time onwards it will increase.

though cances of getting caught are little but still its not advisable.

 

Its illegal to upload pirated contents to server. Even the site owner is responsible for this act.

 

Best bet is to get offshore hosting

Can i allow my users to link to other sites for downloads???
I will post disclaimer and DMCA policy???
Can i do or not??????
