What to do? refund problem

    I am a web designer and i have created a flash file for a client the file was checked by the client and after some minor changes asked for by the client i sent the final project and they sent payment.
    Now after a few days they said the file was not working correctly and they sent screen shots of the problem.
    I tested the file on my server with no problems at all but i tweaked the flash file and sent it back.
    Now this has gone on for about 2 months testing it on the client server showed no problems when i looked at it.

    The problem is i have offered a full refund as a offer of kindness by myself but they are now annoying me with emails saying “don’t go back on our server or we will take action against you”. And other thing along that line.

    What is my legal position the client is not happy with the work but they paid for the final project so do i have to refund? Or can i tell them no refund is available now.

    It shows that how people are. Tell him - if you are so worrying about your server, then change your details.

    You may report this to their server hosting company. Well, don't worry, You must have refund details, so you are safe.

    thanks what i want to know is do i have to refund or do i have a legal position that i can use to not refund.

    this would not have been a problem for me as customer satisfaction is what i aim for when working with a client, but this one!
    after i offerd a full refund and sent a form for him to sign saying he will not use any of my material on his site or pass it on to any other person. he sends a email saying i am just dragging the refund out and. i want to protect my work.

    because i can not get the files back i want to know what i need to do.
    do i have to give a refund? or maybe a credit note?.

    You offered it.. and it is your word.

    Personally if I gave my word I would give the refund and write it off as an expensive lesson and never offer a refund again.

    This is why I got out of website design. Folks were never happy even with what they approved of ahead of time.

    Yeah I know what you mean..

    I always get All work orders and approvals in writing and emails then when people try to say "That's not what I said" or "that not what I ordered" I can copy and quote their own words.

    Then I tell them "It's all you. And what you wanted." ?

    Some people are jerks.

    There are some people you will never please no matter how hard you try. I got some good advice once about really difficult clients who were way beyond reasonable. It went along the lines of.....

    don't bend over backwards to help them because all they will do is kick you in the ba##s :eek:

    It's worth keeping in mind for those occassions.

    Your best bet Granted is to just issue the refund.
    From what it sounds like, it would be a legal issue for you to retrieve your work and in the long run, it may cost you more in legal fee's then it did the refund.

    offer him a refund or tell him there will be no more changes done, and they accept the project as is.
