Depends on the picture. If it is not in the public domain, which most are not, then you cannot legally use it without permission.
due to the digital something law from the 90's everything online is copyrighted automatically. so posting any media or content from another site onto yours is illegal unless you have their permission. many people don't really care if you link back to them, and if a website does care, they usually put it in their publishing policy.
Yes, it is illegal, it violates copyright laws. I put a copyright notices on my photos, but that is by no means required. You need written permission to use someones images. This could be in the form of a preassigned license agreement such as a CC. Most of the time you need to obtain written permission from the author. I'm going to start sending out DMCA take down notices for my photos that are being ripped off. J
It depends on the content of image.. some images are public images like the movie posters etc... The site from where you are getting that pic would even dont need any copyright permission to get those pictures........ so it is not considered illegal unless the one who holding copy right claim against the person who violated the copyright law or copied the right owned picture or content.

Guys, if you are into serious webmastering business then go to a major photostock site like, fotolia.com or stocklib.com and many more....purchase the images and use them, it hardly costs $1 for an image of webpage resolution...copyright is a very delicate issue and needs to be handled carefully, i have subscribed to the services of a cyber crime consultant who specialises in these issues and hunts down copyright issues, i can tell you they can go to any extent, he got an article site (in top 3) to delete content that was copied from my website and pasted as an article in their site just in 3 days, and be rest assured these guys are international professionals working with like minded professionals from other countries who helps in tracking down those webmasters if they are in different country than where you are residing. In my case with article site, i reside in India but the article site was hosted in US, he got a lawyer from the same location to ring up their ISP and lodge a simple formal complaint and the article was removed in a days time along with an apology to my support email address. So be careful what you do!
