Article Site violating my copyright!

    One of my website homepage has been placed verbatim on a major article site (this is one of the top three article site), also that article has been picked up by some blogs showing rss feed from that article site and has made that into a blogpost. Of course, none of these has any links to my site, also the author on that site has just one article online.

    Of course google still shows my homepage to be the original as well as i am on first page of google for my keywords (which has a competition in 100000000), so not much perturbed about that.

    I threw this issue to my lawyer and he contacted the article site who too responded immediately, but they are asking for evidence when my articles came online (actually an year back) while their article came online two months back.

    Of course, my lawyer has sent in the details, it is a week since and now they are not responding to the mails.

    I really want to take them to task and my lawyer is even confident about it, what really surprises me is if they do a simple check on archive.org they can see which articles came online when, either they are testing we are serious about it and know the rules or just plain simple ignorance of a support staff.

    They also display adsense, so i can take give feedback through that article and get them a warning, of course from the look of their ads it do not give me an impression of premium publisher, so they cannot be cool about it.

    What do you think is the best course of action?

    You could ask your lawyer whether it would be prudent to serve a DMCA takedown notice on AdSense: http://www.google.com/adsense_dmca.html

    Also, where is the server of the infringing site located, where are you located, and do you know where the website owner is located or do they have their Whois information privately registered?

    It is a major article site, every detail about them is available with me, but i am located in India, though that is not an issue, since my servers are located in US, as are theirs, so effectively if i m not wrong the copyright infringement is happening in US

    I am not a lawyer...
    I have however, dealt with legal issues for many years in a professional capacity.

    I all takes time.....most of the legal rules allow the "bad guy" a certain amount of time to reply to any charge.

    Sounds like you are right on target. You have to give your lawyer time to get it all done.:)

    All is Well that ends well, today my lawyer got the response from the article site that they have removed the article from their site as well as servers and they are investigating the author account.
