Reg fee. BlackEyedPeas don't have any affiliations in India. However, if they did decide to hold a concert there annually, you could be holding onto a reasonably valuable domain there. Currently, <$10, if what I said does come true - low - mid $ xxx.
Estibot is for entertainment purposes, it's not any kind of appraisal that anyone would take seriously. "Black Eyed Peas" is a registered trademark of the band. If you were to use it for the actual Pea , meaning the vegetable, you would be fine. The minute you use it for anything having to do with the band, and/or try and make money from it, you would be in violation...so for that reason, I don't think it's worth anything to anyone except the band, and since they hold trademark..they could just take it from you. Trademarks are bad investments because most people are smart enough not to touch them. They are only useful in countries that don't recognize or adhere to international TM and CW laws and even then it's sketchy.
Why am i wrong and not you? Ok, i ask for an appraisal so i have to be expecting all types of answear but i received 4 appraisals and 2 of them said: reg free, and others 2 said: low xx and low xxx. Who is right? I don't have any doubt that blackeyedpeas.in is a good domain, otherwise i didn't reg it.
It's not worth anything to anyone because it s a registered trademark. Yes you are right, it is a good domain...that's why someone protected it years ago. As I said, if someone used it for a site about Peas, then it would be O.K, but who would start a site about peas ? I agree with you, you had a good eye in registering it, unfortunately you are about 10 years too late, and didn't check your trademark law before you did so. Just because something is available doesn't mean that you should register it. You aren't lucky, it's just that everyone else knows better than to touch it because it will do them no good, and be a waste of reg fee. I'l bet there are a ton of trademarked names in International Extensions that aren't registered. Because they are worthless to anyone but the Trademark owner. If you found "SonyEntertainment.net.bz" available, would you register that too thinking it was a good domain ?
Well i can easily open a forum about blackeyedpeas to indian fans (that are increasing), i can open a fan blog or a non official fan website, do you think that BEP will proccess me because of that? I'm just supporting the band, what i'm doing wrong? It depends of how i use the domain.
LOL, i'm just supporting the band. They don't have a indian fan site so if i create one they win with that, i can win 2 but they win higher.
That's a nice attitude, but people protect their brands to prevent unauthorized use and promotion. Who knows how they will react, but it's not necessarily the band that you have to worry about..it's the record company that they are under contract with. The music industry is particularly sensitive to outside attempts to pirate a brand that they have a right to. I'm pretty sure that the B.E.P's have a fan forum and if they want to tackle the Indian market, have the resources and money to do so...in other words..they don't need you to promote their brand, they already have a marketing team to do that in the way that they want it done. It's playing with fire, especially since the domain is the exact protected trademark...consumer could reasonably assume that it is owned and promoted by the band or record company and that is what they don't want. Experienced webmasters stay away from trademarked domains. This is an old argument. Every bit of reasoning that you can come up with, has already been discussed and tried. The only what to do what you wish with the domain, to promote the band, is to get permission, and I highly doubt that will happen because what ever entertainment company that they are signed with, surely has a division in that area of the world and will just ask you to surrender the domain.
