Hi, I have my stuff being shared away illegaly. How can I send a DMCA notice to the host? Do I need to be a US citizen, if yes can I have a US citizen to send it on my behalf? Thanks Helv
You can always Contact the Host via their abuse email and Ask them to take down the content. I might have some DMCA emails in my inbox still somewhere would you like a copy of 1 for you can send it in a similar format?
Most DataCenters I deal with forward the email within a week and once they forward it they give the host 48 hours to remove the content. I posted a couple DMCA complaints I received about clients sites below. I couldn't find any about blogs tho but the 1's below might help set the format for writing one yourself.
What country are you in, and what country is your content hosted in? DMCA is a law passed by the United States Congress, therefore a U.S. law... but is a combination of treaties including WIPO. If you are not in, or your content is not hosted in a country that respects the WIPO, then you cannot expect protection from it. Generally, almost all members of the United Nations are included in the WIPO, and non-members are the states of Kiribati, Marshall Islands, Micronesia, Nauru, Palau, Solomon Islands, Timor-Leste, Tuvalu and Vanuatu, as well as the entities of Palestinian Authority, Sahrawi Republic, and Taiwan. If you are in one of the included countries in the treaty, then you don't send a DMCA notice (You are not in the U.S. or a U.S. citizen), you send the appropriate notice of infringement from where you are.
