I'm just now looking at this thread again. Wow, dude. If you get the wrong judge, you will do time. Seriously. But who knows, you may get lucky and all the evidence will be dismissed for one reason or another. Did you meet her online? If they can't use your computer, how about hers?
I still really, really want to know how this ever came to light in the first place? Did she video the alleged deed with a mobile phone then put it on the internet or something?
Young girls are very open on MySpace these days. It's really not a surprise to hear of more and more "alleged" sex with minors these days.
You'll need to get off the Internet and get focused first and foremost in my opinion. If the circumstances are as you state, you need to get off the computer and get busy planning your life, your case and what you'll do when you get out of jail. Trying to focus on police mishaps of administrative procedures and the like will not change the facts in the end. If they have the testimony of your "friends" who will do anything possible at that age to mitigate their own situation and that of the victim, they don't need your computer(s) to put you in jail. Focusing on the closeness of age between you and the victim or anything of the like only shows that you are not cognizant of the severity of your situation. A judge will give you zero tolerance if you fail to take seriously the gravity of the situation, take onus for your actions, and have genuine regret or remorse. A jury will be even less forgiving, because even though they are given parameters, there's a lot more subjective emotion involved with a pool of 12 than with a seasoned, legally objetive jurist on the bench. No offense, but right now if everything I'm reading in this thread by you is legit, then you're being 100% stupid. There's nothing flippant or remotely lol about your situation. Idaho sparsley populated and this crime with the specific circumstances you've listed despite intially stating no details, would make it easy for this thread discussion to be traced back to you and your ongoing case. No doubt you have a zealous prosecutor who is looking to make a name for themselves by making an example of you and your case. Don't make it easier for them. Great post WR - but that's where I am very conflicted - should I, personally, really be offering any sort of advice to someone who is up on charges of sexually abusing a minor? Secondly, there is a HUGE difference in being accused of SEXUAL ASSAULT / RAPE and being accused of STATUTORY RAPE / SEX WITH A MINOR. I believe that somewhere between the ages of 16 and 18 is considered the "age of consent" for most states in the U.S. It is an unfortunate situation, as I have known MANY people, who are dating as teenagers, and one turns 18 before the other. For instance (and this can go either way; it doesn't matter if it's the girl or the boy, who is older - it's still "illegal"), if I am 16 and my boyfriend is 17, but he turns 18 before me, in a state where the age of consent is 18, and we have sexual relations (intercourse or otherwise), it is considered illegal. Even if we have had a previous sexual history, the minute he turns 18, it becomes illegal for us to have consensual sex. Will anyone tell, or find out? Would anyone care? Who knows? I understand the age of consent laws are there to protect children, but these days 15-year-old girls don't act so much like children anymore. Either the age of consent should be lowered - or consideration should be made for the age of the accused. So what, he's 18 - maybe he's been 18 for one day or maybe six months. This should not make him (or her, if the girl is the older of the two parties) a felon for having consensual sexual relations with someone, who has a history or sexual activity with them, or with somene else. lol, okay, all they even have is a chat log conversation from MSN, they don't even have my email address, they just have my display name and the chat logs. I'm bringing up how little this is obviously in court but since that's all they have I REALLY doubt there's a way they could convict me. What? I'm not being ungreatful, I'm trying to be in a "cheery' attitude alright. I've been doing nothing but planning and talking to lawyers ever since this first started except for the times I'm at work or trying to do some recreational activity (internet stuff) I just thought it was funny that he found my myspace, I KNOW that was off of my myspace, I simply asked how he found it. idk, maybe I wrote it where you'd mis-interperate it but I wasn't trying to be disrespectful, hell, I've been thanking everone practicaly every other post. I appreciate everyone trying to help me, the reason I'm even talking about it is actualy just for moral support like in a family, not really legal support. You guys aren't a replacement for a lawyer and I'm not trying to use you as one, I'm simply using you guys as people I can talk to. What I meant when I said I was hoping it wouldn't be a problem in the first place was that even though it looks like the case is on my side it still scares me because I don't know for sure how it's going to end up and that it's already ending up where I didn't expect it. The whole reason I even started this thread was because I was afraid when this got brought up and I just moved, I have no family nor friends in this area as of now and I have nobody to talk to to let some of my feelings out. It just feels better when you tell people what problem you're having. I don't know, either way it might be a good idea to stop this thread just because of what people can find. It's a small town investigation and they are VERY computer ill-literate. I don't think they thought about the fact that anyone coulda either been on my user and/or use my display name and say they're me.
