If I have a URL that contains a trademarked resort name but the site contents have nothing to do with the resort, can they legally tell me to take the site down and/or fight to take over ownership of the URL? It depends on the exact trademark you are talking about. A trademark holder can sue you for any domain they think is infringing upon their mark - whether or not they will win in court is another story. The cost of defending a lawsuit is huge, so that should be considered.
Tell them you did not realise the problem, but would sell it to them if they are bothered by it. Put a cost to it, not over the top, but think of the time and money they will save by just buying it. Good Luck..
