Hi Dpers, I am thinking to build a website with many popular tv episodes such as gossip girl, simpons, etc. I will get the source of the videos from shared content from other site and my website will stream the video from there. I am wondering if that kind of website can be a big problem in the sense of Digital Copyright issue? Please advice and Many Thanks for any thoughts
i was going to post a thread wondering about the same thing... because these TV shows were offered FOR FREE on tv, so anyone could have recorded them with his DVD/VCR... if the producers want to make profit by selling DVD then why publish it in Tv for free right?
*cough* T.V channels pay the producers in millions and they in return get paid by adverts and you pay for your cable or sat t.v. nothing is free to OP it will will depend on where you are and where your site is hosted. all T.V shows fall under DMCA but it is useless if you are not in U.S.A. even if you site is hosted on a off shore server and cannot be linked you if you are in states, DMCA is a american law.
No i don't pay for cable tv(we don't have such a system in the middle east) you buy your own sat. dish, and a receiver and you get all the free channels in the NileSat for free (for example) Mbc pays for the show, and they air it for free. The only cost we bare is electricity The tv channel gets money from ads not viewers.
So actually, if I am not from the US and I am using a offshore server, I can build as many tv shows/movie websites & keep them without getting legal problems, hum?
in the middle east YES i don't find any legal issues, here's a very famous Arabic Tv channel that comes for free in Nilesat (or Arabsat) check it out and see what they're showing for free !
Recording for personal use isn't a commercial development. Taking those recordings and commercially selling them without permission is illegal. Thus, the same with a website... I'm sure you can pay a royalty fee for use... but without permission you'll lose your website in the near future (or end up in court).
Some videos will be fine, while others hold some copyright claims which may not be allowed to post. I'd research other TV Show hosting sites, see if they have any qualifications.
Many are making it, so not such a big deal. Make sure to add a discalimer that you do not host or upload and add your email so they can get intouch. That way you should be fine. Yes i just got 1 made.
Legally, you can't take someone else's property and replay, rehost, charge for, add adverting to, monetize, or offer for free to others without permission from the owners. That is the way it is. Just like no one can take your property and give it to others. If you are in some rogue nation that doesn't adhere to the rights of ownership, then that's another story..you won't be breaking your laws, you will simply be considered a pirate to everyone else's. Do not look at others and say "IF they do it, then it must be O.K". Most times you are wrong...you should check and see how, or why they can do it before making assumptions that it is O.K. for you to do the same thing. Just because I have a deal in place, doesn't give you the same rights to the same deal. Besides, there are enough sanctioned outlets to watch T.V. episodes made available by the producers, networks, or advertisers. It's not such a big deal anymore, you can go to the producers websites and watch all the T.V. you want for thousands of shows for free. Why re-invent something that already exists legally ? Contrary to popular belief, T.V. is not free. It is paid for by advertisers. T.V. only exists to advertise..it is an advertising medium. That is what it is for and what it does...any entertainment that you get from it is only there to keep you interested and coming back so that you will see the ads. Not out of some humanitarian concept to provide you with free entertainment. You should really understand the industry first, before you look to infringe on it for personal gain. It may save you a lot of money and heartache in the future.
