do you know how to copy right a domain name. or if a company is copyrighted can you still purchase a domian in that name. any info would be great dr.web
First off.... This should be put into the "Legal" forum. Second Off... You can not copyright a name. You can have the name Trademarked. If someone has a name Trademarked and you buy a domain name under their name or you have their name in your domain and you are doing the same type of business as them then you have violated trademark laws and could be and most likely will be sued.
so if i registered a generic business names like greenestates.net when someone else owns greenestates.com then i could potentially sell this to the .com business if they wished to purchase without vilolating any rules ? do you think there is a buck in this, plus i am in the uk so do the virgininia us rules apply to domains registered in the uk ?
If they have a trademark on "greenestates" (or green estates or whatever) then they can just take the domain from you when you offer to sell it to them, and you get nothing. Read about UDRP here: http://en.wikipedia.org/wiki/UDRP
i would not recommend you to do that since there is a risk, before i did receive a legal letter from a company and i finally let the domain expired and forget it. so poor...
That's why I'd never buy or develop a .net if the .com is already being used in commerce...or if it was trademarked.
Personally I wouldn´t buy a domain another company could cause legal issues with (in the meaning of a company´s brand), I´d rather go for keyword domains.
If you have International Trademark of this name mean yourdomain then anyone cannot use yourdomain .com .net .org bla bla If you have please contact me. Thanks
I know. That's why I said it's case to case. If someone has an international trademark for Apple to sell computers all over the world, I register AppleHairGrowthdottld to sell hair products, am I riding on or infringing that party's trademark? Apple isn't stupid, by the way.
