    An elaboration on my previous post regarding copyright infringement and the legality of linking to a copyrighted file, even if you do not host it yourself:

    I studied this and other cases at Cornell between 2004-2007 and believe me, just because you don't host the files does NOT mean you're not violating copyright. Merely linking to or embedding files is contributory infringement and is liable to suit.

    In the case of most of the people in this thread, saying you "didn't know" will not release you from your liability -- clearly, if you're putting up a website based around watching movies online for free, you are knowingly abetting copyright infringement, and if you have cpalead's gateway up, you're doing it for monetary gain (even worse than if you were doing it gratis).

    I'm not saying to stop doing your sites or anything (I've made hundreds of thousands of dollars from CPALead and other affiliate companies, so I know the monetary temptation is there), but be careful and know what you're up against in the unlikely chance of you being targeted by The Man. There are ways to use CPALead's gateway without breaking the law. :)

    The question is how are large sites still online ?
    Will they know the owner of the site to sue? I mean lets say he has fake domain info?
    If all my files are hosted at certain video sharing website and I did embed , Why don't they contact the site owners and ask them to delete? A lot of sites delete once they recieve infringment !
    Also,If you can check a lot of tv shows now are being shown at google , youku , megavideo , veoh , youtube too !
    They can't handle these millions of links and videos shared anymore !

    The thing with Google Video, Megavideo, Youtube, etc., is that they have what is called "ISP" status. What this means it that they have two options:

    1) they can self-moderate, so that if anything illegal is on their site and they don't delete it they will be in trouble, or
    2) they can act on a case-by-case basis and delete the files as they receive requests. By *NOT* moderating but instead reacting to complaints, they are not held liable, as they have no reason to know something is on their servers.

    This is how sites like sidereel get by, too: they don't upload their own links, but their users contribute links. If they get a request or a notice that they're linking to illegal files, then they remove the links from their site.

    The difference in Youtube, Sidereel, etc., and most of you guys' sites, is that in their case THEY are not uploading the files, so they have no reason to suspect that the files/links are illegal until someone tells them that they are. In most of your cases, YOU are uploading the links/files, therefore you are knowingly infringing (or at least aiding and abetting) copyright infringement. You can't say "I didn't realize" when you are the one doing it yourself, not your users.

    Does this clear it up?

    EDIT: Regarding using fake information on whois, there are two problems with this approach:

    1) the copyright enforcer can contact your web host and ask them to remove access to your site, since your nameservers cannot be faked and will immediately give away the host of the site with a simple whois inquiry, and/or
    2) since it's against ICANN rules to use fake info on your whois, they can contact the registrar and have them disable your domain until proper identification is given. No domain registrar, no matter where they are located, is going to deny them this information, because when they make their business through Verisign and other companies they are contractually obligated to follow the rules set forth by ICANN. If they don't, they won't be allowed to sell domains any longer.
