I am allowed to use copyrighted images on my site as long as I have a disclaimer on the page saying the images are copyrighted to the respective party, or would I have to contact the copyright owner for permission to use the image first?
You would need to contact the copyright owner and ask for permission to use it. Of course if you offer to provide full acknowledgement next to the image and a link you will probably get a more favorable reply. You could also phrase the request as an offer to promote the creator's work on your website with link to the source, etc. But of course, it depends on the source. You will probably have more luck dealing with a private individual than a corporate publisher.
You have to ask the owner of the photo for permission to use it. A disclaimer won't really help you if they really want to sue you for copyright infringement.
You cannot use any copyrighted images unless you have the permission of the copyright owner, even if you aren't profiting from the use of the copyrighted material. I learned this lesson the hard way. Good luck!
Agreed. You will need to obtain permission from the owner in order to make use of it. If he or she request that you give credit, you will need to do this as well.
