What does the law say? Can i sue them?

    Hi!

    Today i was analyzing the backlinks of my website and i found a link from the website of a Webdesign Company. By clicking through their website i found out that they are showcasing my website www.punkz.fm on their website as their work. But the fact is that they didn't design my website. So they use my website to scam their customers.

    What does the law say to this? Can i sue them?

    First off you should contact them telling them to remove the showcase of your site from their site. If they fail to comply, you could take it a step further by talking to a lawyer. If they live in the states, I'm assuming that you do, you could take them to small claims court. A court subpoena alone should be enough to incite them to take it down. But contact them first.

    Do you want to spend $25K to sue them and then be asked to prove damages? What damage did it cause you?

    Forget about getting any money...

    Have an attorney write a letter to them. It is very costly to have a lawsuit even in a small claims court. What country are you located in, by the way?

    You should contact them first. If you don't respond then contact their hosting company and tell them about the issue.

    Also, the point of sueing someone is to protect yourself, not to focus on gaining money from them. Another fact, it does cost a lot to gain a lawsuit.

    Law is not to make money out of others, but to provide justice! You better keep your priorities right, as the intention of making money may as well backfire.

    You didnt make the script in the first place http://www.phpfox.com/ is the original author....?

    Also on the TOS of phpfox it states you MUST leave a backlink to phpfox website unless you have paid for extra fee to have it removed, have you?

    Also you have videos from theTingTings and a few other bands, can I ask do you have permission for that also?

    Congrats. You're on the level of some of the homeless I volunteer for. Trying to fake injury to get money out of someone.

    Interesting that you didn't mention the phpfox question nor the references to the various bands. Haven't they been harmed? Shouldn't you be paying them for violated their rights?

    Contact the site in question as well as their host and request that they remove reference to your site. If they don;t follow up, then you can consider a C&D order.

    You have NO rights at all, I have emailed phpfox to make sure you are using a LEGAL script which is not nulled and make sure you are allowed to delete the footer backlinks to phpfox!

    I created the theme, so i own it! I have all the rights on it. This isn't about phpfox software Ok. You are beeing offensive on me without any reason. I reported your post to digitapoint.

    I don't violate a single copywrite law. The Videos on my website were uploaded by members from youtube. I own a phpfox license so why should that be a problem? In fact, they gave me a backlink because i am their featured client. Look at their featured clients list! I think you guys here just want to piss me off because my website is just better than yours! .:mad:

    To all of you: I was just asking a question about the legal situation of my case. You are all beeing offensive on me with no reason and i have reported your posts to digitalpoint.com

    You have misread what I asked!

    I asked if you have paid to have the footer link to phpfox removed as your are using software provided by them. Have a look at the bottom of this very site it still includes the copyright of the author for the script of this forum:

    vBulletin® v3.8.3, Copyright ©2000-2009, Jelsoft Enterprises Ltd

    Its only right if you use someones software that your credit them unless they state you dont have to OR paid extra as in the terms and conditions on phpfox.

    I did see the website that claims to have made your website so I would suggest that you contact them as by the looks of it they have had that "template" for a long time with alot of downloads over the past year or so.

    You asked for advice from others and not always is that advice going to turn out the way you want it!

    As for the videos on there im sure you WILL learn the hardway.
