Is this theme legal or against the Adsense TOS?

I have a question about a wordpress theme that i found and i want to know if its alright to use or if its against the Adsense TOS.

The theme looks like Google's results page. If you place an add above the posts, you could make the ad look EXACTLY as the post and Adsense can ban you if you trick users and extreme blending.

    Heres a demo: http://ericulous.com/demo/index.php?wptheme=Woogle

    Thanks, fuser

I don't think it is good to you.

Here is the rule you should think about it before you take the action.
    * Keep AdSense ads off of your registration, confirmation, and all "thank you" pages.
It makes sense that those would be wonderful locations. Google thinks otherwise, however, and doing so is a hanging offense according to their Terms of Service.

I thought it was against the TOS. If you place an ad above the posts.. you could trick people as the ads and the posts would look EXACTLY the same.

    Thanks, fuser

Risky! It might not be against the letter of the law, but I dont think they would be happy...

OK thanks guys. So we agree its against the TOS or could get you banned BUT could get you a lot of clicks as visitors could get confused and click the ad instead of the post link.

Maybe using yahoo ads or adbrite..

    Thanks, fuser

PS: How can i contact a google adsense team member to personally ask them if its illeal?

There is an Adsense help forum, and an adsense email address for support depending on what country you are in.
