Is email harvesting legal?? I was trying to build by a list of email using email searching scripts?? and also was thinking about offering services for selling the same?
I don't think that is legal... I think to be legal, the users would have to 'opt-in' meaning that they know that they are signing up to receive emails from you.
You have to have a one click opt out for the recipient as well as your physical address if they want to opt out by snail mail. Other than that, no porn an be sent. I do it all the time and it's effective for the people I target.
How can they 'opt-out' if they haven't even opted in? Am I missing something here? Where are you getting these addresses from? Kevin
You are allowed to send one email to someone giving them the opportunity to opt out. If they do not opt out, you may continue to send as long as they do not opt out. I buy lists pertaining to my particular business.

A lot of times when people sign up for a newsletter, free info... things of that nature, it is expressed to them that they will receive emails from associated companies or partners. They are also given the opportunity to opt out of other emails by simply checking a box. Many people do not opt out and those email addresses are used in many email campaigns. That's perfectly inline with the CAN-SPAM Act of 2003. I personally think that the whole issue is overkill with the spam filters we all have in our email services and when I get an email that I am not interested in getting, I just delete it. To make it a Federal offense is, IMO, silly and is just another law initiated by overpaid lawmakers trying to make themselves look like they were doing their job and taking away more freedom from US citizens. Government intervention is not always good and in this case they went overboard.
but thing is ..... actual question is "Is harvesting email - and trying to reach targeted audience" - is legal ?? or not IS it an issue being in US or this still implies to people sitting outside US ?
