I have a product that is banned for sale in the UK but is legal to sell in many other countries. I am based in the UK but the product is shipped from a country where it is legal. If my website is hosted outside of the UK and provided I do not ship to the UK do you think that is ok? I think its okay if you host your website outside of the UK and do not ship to the UK. Since the product/server wont be in the UK or will ever come to the UK!
You're still subject to the laws of the land in which you live. The product is banned from sale in the UK. But, what does the law actually read? Does it say anything about distributing by UK citizens located in the UK, but the product not ever touching the UK? You need to find the actual law and look at it, I would also consult a lawyer for this. You don't want to get hemmed up, but, if it is ok to do so, you don't want to miss out on an opportunity that could potentially net you some decent cash.
Exactly! Thats something I forgot to mention. You have to read the law and see if distributing by UK citizens is allowed. Only then can you do what I suggested in my earlier comment!
To what extent is the product illegal? I mean sometimes exports can be checked and of course your business will have to be registered. You can't have a registered business selling illegal products.
