One of the members of this forum hijacked one of my articles from one of my sites and published on this forum: http://forums.digitalpoint.com/showthread.php?t=1274412 I have contacted this person three times, through email, private message, and a post the the thread asking that this be removed. I've heard nothing. I can't get a reply. Can you please remove this thread? I'm not sure what else to do. This is not only copyright infringement on the part of the individual who posted it (a crime), but it's also plagiarism. The bottom line is that this person is has no problem at all stealing from others for his/;her own profit? Why would you allow someone like that to stay on this forum? All of his/her posts should be deleted. Sincerely, Jinger Jarrett
The thing is that it may be very difficult for the moderators here at DP to determine who is the true owner of the content. I mean, there is no actual proof that the content is yours. I will advice you to rewrite your content and forget about that looser. He will surely pay for this if he keeps on doing it.
Actually, I can prove the content is mine. The date time stamp on the file. I wrote the article on the 16th of March. Also, I submitted it through Article Marketer not knowing that they no longer post to Ezine Articles, which is the site that caught this mistake. I posted it to my blog. The article was part of an 8 part series. All you would have to do is compare it to my other work. There's a huge trail here. I have to ask: has this ever happened to you? If it hasn't, then you have no idea how it feels. Do you really think that I would make the accusation if it weren't true and subject myself to the ridicule that can come with it? Besides, why isn't this person defending himself/herself? I've repeatedly called this person out to no avail. I agree with you. This person is a loser. It does not rectify the situation though. Perhaps you should file a DMCA take down request with this website and then they can act. I think they don't listen to some random post where people claim to own something. While you seem to have a claim to the works you need to go about asserting your rights to it in a more professional manner. Users here can't simply delete a post. That is not a option even if he wanted to. So, in order to get the website to take down material you feel is yours you should simply file the proper notice with the website.
Looks like you might not be the only one he has borrowed from. Here is another post that looks ripped- http://forums.digitalpoint.com/showthread.php?p=10943251#post10943251 From here- http://www.adsensepark.com/a509838-do-you-want-to-maximize-money.cfm Or maybe one of the other 4 sites that come up when you Google "rates of Google-bastion and click-draining will increase".
Hi once more jjarrett, i understand you very very well. In fact i have been a victim of that so many times!! I can assure you that the first time always feel like you should die. I can remember the first time when this incidence happened to me! when i was just starting out on the internet. I submitted an article at buzzle articles, then just few days latter when i typed the title of my article in Google, i found it on about 10 different sites!!!!!!!! I am not kidding here. Worst, they did not link back to me at all! Most of my articles are like that. I have become used to it now. I don't have much time for those people anymore. People do think differently though, you may take it one step up. I think it is high time we started stopping the stealing of content on the internet. It is a good think that you can proof the content is yours!
So how do you do a DMCA request? This is something new to me? I read the terms of service, as well as the FAQ here. They don't make it easy for you to do anything around here.
best case would be ask the mods to remove the thread. Report the thread. if mods take no action well I guess going the legal route can be really frustrating and time consuming. since this is a forum no legal actions can be done for sure as anyone can post in forums
You should you have your articles licensed by Creative Commons to prevent this kind of behaviour. creativecommons.org Regards Alex
Here is a list of the DP mods - a green dot means they are online: http://forums.digitalpoint.com/showgroups.php I would PM one of them. I'd note that jhmattern is also a writer and is familiar with copyright issues, so maybe try her first? You can also click the "report post" icon on the bad post (it's a red triangle with an ! inside it). Those reports also go to the mods. If that doesn't work for you, you can file a DMCA complaint. There are some basic directions here: http://www.plagiarismtoday.com/2007/07/12/new-feature-stock-dmca-and-cd-letters/ http://www.plagiarismtoday.com/2006/06/22/proper-use-of-the-dmca/
Because, that does not comply with copyright laws in the US (which, is where DP is located). US Copyright law requires EXPRESS PERMISSION. Merely providing a source does not satisfy that requirement. Stealing is stealing, no matter how you sugarcoat it.
