Lost Chargeback...what to do next!

    So I sold a commemorative plate on eaby. Shipped it off. A month later the buyer started a chargeback against me through paypal. So I faxed the USPS documentation to paypal and the guy. The guy emailed me and said it was his mistake and he did receive the plate. So i forwarded that to paypal. He also initiated the cancellation of the chargeback. Well he never finished the chargeback cancellation.

    I lost the chargeback of course...I'm sure Paypal did not even fight on my behalf! So they just took the money out of my account and told me too bad!

    So what is my course of action? Civil Litigation?

    Im in Ca and he is in Mass. All i have is a business name and address. I have no other info. So I need to take him to court? How?

    I need to Subpeona Paypal for their records? How?

    Its only $125 but it is more the point of the matter. I got royally screwed!

    Why was you not covered under the seller protection policy ? As long as the goods physically existed and you provided proof of posting, you should be covered ?

    I did not get "Electronic Tracking" and this is the only reason why Paypal did not cover me!

    I would take that guy to court! I have a law degree and I can say to you that PayPal have acted unfairly against you.

    You have a very high chance of winning the case. I know its only $125, but at the end of the day, its principle!

    Are you sure he request the chargeback?
    maybe he paid you by a stolen credit card, and the address of the shipping is just a business address (Mail Forwarding address)

    maybe he is in other country and he just use Mail Forwarding service,
    because its high risk for an American to play these games..

    If you can post his address here, so we can know if its Mail Forwarding address or no, or simple go to google.com and search his address, after you find the company who provided him with the mail forwarding service you can call them and report your case to them, i am sure they will work with you, and they can give you his real address, and also if they not shipped your product to him they will be able to back it to you, they can even submit a lawsuit against him because he used their address to buy products by stolen credit card,
