True, except that Google will only show show one in its SERPs that it regards as the original version. Other duplicates will be ignored. So technically its not a penalty.
eh??? What do you mean? It certainly won't help you rank for anything. In fact, it will be detrimental to ranking because you'll bleed PR along the link. Or do you mean from a legal point of view?
