Okay, basically I run a blog site which is hosted in China and quite often reproduces short articles from articles site. The articles site only allow publisher to reprint Authors articles up to 25 articles a year, but, does this affect me (free of trouble) if I publish 80+ articles a year.. since China Laws is differ then that of USA? What frustrate and worries me: The articles site (TOS) only allow you up to 25 articles. They will take action if their TOS has been violated. Why I believe I can: The authors allowed you to republish their articles indefinitely. My site is hosted in China so their Laws & TOS is acceptable. So, what do you think? Should I continue to publish articles on my blog site or so I be wary?
If you don't follow the site's TOS, you might not have problems with your China host, but a DMCA filed with any search engine like google, yahoo, or MSN is going to remove your site from their index - as it sounds like you would be publishing articles without permission (more than 25). Why wouldn't you want to follow their TOS?
good response mjewel. The TOS is put into place for a reason. People who dont follow them makes it harder for those of us who do. Just a note
Thx both for replying. Simple, I'm busy all day studying and working so reusing others Author articles is one of the easiest method for keeping my blog fresh so the more the better. Beside, by republishing their articles I'm helping them getting traffic by including their resource box -- it is the Article Site Owner who's strict on the publishing limits - Not the Author themselves. Anywayz, as long as he can't sue or do me harm then I'm in good company... as for SE? Screw Em'
Really?? Yea, I'm from US. I know a couple of people who also lived in the US; they also host warez sites and others things considered unethical here in America but once they host offshore like China, Russia, Netherlands.. etc they're safe so I think I'm in good hand
What matters is where YOU are. People assume because they have an off-shore host they are free to do as they please. Reality is that you can still be arrested or sued. What off-shore allows is a US company from sending a C&D or DMCA notice to the ISP and the site taken offline. DMCA is a US law so a host in China can and will ignore it. But if the site can be linked to you as a US resident...then you can and very likely will get into legal trouble.
Yes this is true. If you use WhoIs privacy it makes you harder to trace. IMO if you take 100 articles a year from Ezine, they're not going to do anything. Also, why would you want to copy articles? It does nothing for your SE ranking, as you are in direct competition with big article sites with exactly the same content as yourself. It takes 30 mins to re write an article, and the results are much, much better.
