Good afternoon everyone, I am currently looking for the best method of protecting my companies website. The site allows for online investor-to-company conferences. The issue is making sure the Terms of Use is read. Are we liable, for instance, if in this chat room a company discusses illegal insider trading issues? Would everyone going into that chat room have to have read the Terms of Use before entering? Upon entering the website? My company is quite small and no one here is a legal guru. We would obtain legal aid but are cash strapped at the moment. Any help is very much appreciated.
the TOS should always be required to be read by the user, it is better to be safe than sorry. I own a web hosting business and we require the user to check a box that says, I have read and agree to the TOS next to it. They have to accept before creating an account or making a payment.

You could always make a Terms of Use page as your index.php/html/asp page. Require them to click a box that says "I agree" on it. Generally though, you wouldn't be held liable if someone talks about insider trading or other hings of that sort unless you monitor the chat all the time and don't do anything about it.
yes, absolutely, it forces them to select/mark the TOS, before allowing them to enter into chat, and it would not hurt to have a TOS link in the chat room, and on the website. you have to remember that 99.9% of people do not read stuff like that. it is better off to protect yourself the best as possible.
