how to solve forum illigal problem

    now i just created forum site , so admin is no responsible for any illigal done by user , so if user do any illigal , admin caught are pay some amount is it?
    i worrying about that
    how to solve the froum illigal problem like downloading mp3, content copy, and so,..................
    pls help me

    You just need to put some rules that user accept when sing and mantain the forum as clean as possible. There is no real legal responsability, unless the forum goes in something really bad and dangerous (terrorism, killers, etc), but warez and things like that are not prosecuted on forums by the law.

    as a siteowner and registrant, you are directly responsible for any content contained within your forum. Should any legal battle occur, you will be drawn into it, no question. Having a disclaimer will not help in the slightest.
    I've had it done to me, and its not fun.

    yaseen4u. you would probably get better answers if you posted in the correct forum, not the google one.
    Basically have rules. Have moderators to remove content against your rules, ban people who keep breaking your rules. That's about the most that most forum owners can be expected to manage to do.

    i guess you need to have warez linking hosting , privacy protected domain

    but really why u want go for such forum creation waste of effort and time

    the forum owner has total legal resposnsibility for what is on his forum, and can be drawn into legal proceedings as a result. Lets say for example one of your members publicly makes up a story about a company not delivering goods etc. The company in question can file a suit against the poster involved but also YOU ! for leaving it on YOUR website.

    Another example.. a member on your forum buys a product from a company advertising such product on your forum. The company goes tits up, and the member loses his money and never recieves his product. The credit card company and the legal company trying to retrieve monies can take action against the defunct company and YOU for introducing the two parties in the first place and allowing them to conduct all business via your forum. ~In this case you are not actually liable for monies, but you are legally obliged to help in any way you can in order to retrieve lost monies, and this can get pretty complicated.

    I say again, disclaimers will not help. Moderators and admin are there to keep a check on things like this.

    maybe i would suggest you to host your warez forum on an offshore server... but what i know is that warez linking is legal and warez hosting is illegal

    maybe i am wrong ?

    Excellent info and you're 100% correct. Forums and other sites where content is posted by a 3rd party are covered under the Communications Decency Act, which Clinton enacted in 1996. Basically, site owners are not liable/responsible for content posted by a 3rd party.

    I believe that was a made up law created by warez forum owners. I tried looking it up once and everything I found said there was no such act ever signed.

    exactly.. i stick to my statement. Forum owners and site owners are personally responsible, and therefore liable for anything that is contained within THEIR website.

    it depends on many factors. Your forum will automatically out of ILLEGAL after some time.
