Can i use a domain name and then fake

    I want to pick out fake or real profiles on a website so my domain name will be something like.

    fake-on-xxxx.com

    Can the owner of xxxx sue me for using his name and is it better to use something "short" for his name.

    If his name is "sample domain" i use fakeonSD.com

    I know MSN goes after people having MSN in their name also PAYPASUCKS.com but they have no problem.

    Whats your thoughts?

    It doesn't work like that way my friend.One can sue you if he is trademark holder,rich enough..etc
    Don't play up with big websites....

    If you use it for monetary gain, you will usually get into trouble, but if it's for a fan site, then it should be ok, just my 2 cents ;)

    What do you mean by "fake or real profiles"? From what else you've said I would say that as long as it it isn't an imitation site you are fine. You can't use their trademark for business purposes. If it is journalistic then it is fine. That is why paypalsucks.com can live on. Because they are trying to explain to people how they have been wronged by paypal, and since paypal is a US corporation, it would be protected by the 1st amendment to the constitution as free speech.

    If you had the domain "paypalsucks.com" and used it as a competitor to paypal, then you would be sued, and you would lose.

    That being said, even it if it legal, you can still be sued. It's doubtful you have the legal resources to combat a large corporation, or would want to for a silly domain name. If you do I would suggest taking the subject up with your legal team.

    Would that land me in problem?

    Now i have a domain name with some of their domain name in it so i think i will be fine.

    It doesn't work like that.

    If you are using a trademarked name or are using a service mark they can put in an dispute with ICANN.

    Whether or not they do depends on whether they want to, not on what you are doing on the site.

    A lot of it depends on the reason you have registered the site, what you are using the site for and also whether or not the original site believes you are trying to mislead people or take business away from them.

    Sites like paypalsucks are fansites, although its negative, its giving paypal publicity and they don't mind that.

    well, if your web-site is to provide information about how to differentiate the real thing and fake, and not for other purpose like advertisement, actually I think it is not easy for them to sue you. Moreover, if your web-site goes success, they may contact you and you can consider cooperate with them to gain some benefits.

    fakedigital.com is nothing like digitalpoint.com so there would be no problem.

    If you registered fakedigitalpoint.com then yes there could be a problem

    No. You Can Not! You cannot use a trademarked name, or any variation of it (adding words, plurals, IDN's, etc) to make money. Plain and simple.
