im trying to figure out the max similarity percentage between two pages you can have until it is considered duplicate content?

Also if i have two pages with the same content but the one menu uses tables and the other page uses <UL> LISTS will the pages still be considered as duplicate?

    Thanks all:D

If content is the same of course it will be considered as duplicate. Even if you change some words it can be flagged.

modifying the html around a page won't change the way search engines detect dupe content. They remove all the html before shingling anways, so don't waste your time.

personally, I aim for 65 -70% unique to get by the engines.

For me at least 60% of the content must be unique to rank on the search engines

Changing 51% from original content can escape from duplicate warning.

For similar page structure like menu and other stuff use link canonical tag. you will find it on google webmaster tool blog.
    http://googlewebmastercentral.blogspot.com/2009/02/specify-your-canonical.html
Then you just need to worry about Body text duplication.
