Every state has laws that prohibit the misappropriation of another's likeness. This means that you cannot profit from the unlicensed use of the voice, photograph, or picture of another person. What was the nature of your agreement with the musical group? Not every contract must be in writing to be enforceable. An oral agreement may be enforceable.
Stop posting about it online and see a lawyer in person. There is a good chance that you own the rights to all the photos and could use them in a book. You really need a lawyer to help you determine your rights and the best way to proceed. I would not try to get a contract until you speak to a lawyer. Your efforts to secure rights that you may already have could end up hurting your claim. In addition to probably having rights to your own photos, you may have other claims against them for the time and money you invested based on their promise of cooperation. See a lawyer. If you need help locating one let me know and I can try to help.
This is not accurate. Photographers often take photos of celebrities and profit from those photos. No license is needed to take photo in public and profit from it. That is the very nature of paparazzi photos that you see everywhere. What you are not allowed to do is use that photo to endorse a product or make it seem like the person is endorsing or selling a product. There is nothing that would keep a photographer of selling or using a photo of celebrity and profiting from it, so long as the photo was taken legally. Selling photo of celeb on the street - okay. Selling photo of celeb on street to be used in advertisement for jeans - not okay.
No problem. I answered your PM about a referral and I deleted the part of your post that I quoted. You are much better off not having those comments in print.
