There are lot of site which decodes the youtube or other similar youtube like video sharing site url to the original .flv.

Is it legal??

 

If it was illegal, I think this site will be closed already.
But I dont think it is illegal actually since the .flv file comes from youtube hole itself.
So, they should do something to prevent people from downloading the videos.

Its not illegal. But when u download the video from youtube and make any changes to its content, then it becomes illegal.

 

So, If I fetch any content from any site:- It is not illegal??
Suppose I fetch the result of keepvid.com to my site - Is it legal??

 

The argument that it must be legal because they are still around is ludicrous. The mafia has been around since the middle of the 19th century. That doesn't make their activities legal. OLGA (online guitar archive) was serving guitar tabs for a decade before the music industry decided to go after them.

As to whether or not it is illegal would depend on several factors. One, if YouTube considers the way they serve videos as a form of copyright protection then a site like keepvid could be considered as a method to break copyright protection. That is illegal under the DMCA. Second, is the original video infringing or not? If the person that uploaded a video to YouTube did not have the right to do so (say a sporting event they taped or a tv show they ripped) then your use of that video could still be considered infringement (though YouTube would be protected). Third, what are you doing with the video. If you are simply putting the video on your harddrive for when you do not have access to the internet, then you will probably be fine. If you intent to post that video on your website, that could be copyright infringement. In this case, even if the original video was not infringing on YouTube. By you bypassing their ToS and downloading/serving, rather than embedding, the video, you would no longer be using the video in the manner that YouTube requires and would violate copyright.

 

There are many sites out there like this. And technically if you don't change anything and redistribute it, nothing is wrong

 

There is more to it than that.

 

It's legal. When you stream a video from youtube you are still downloading it, just not saving it to your hard drive. You could easily save it to your hard drive without KeepVid or similar sites. As long as you are using the videos for personal use you should have no issues.

The argument "it's around so it must be legal" is totally insane. There are unforunatly child porn sites on the internet, and even though they exist they are far from illegal.

 

While to a programmer or a techie viewing an embedded video is the same as downloading, in the eyes of the law they are different. The Google v. Perfect 10 case makes the distinction between the specific act of downloading and the incidental downloading that is a function of a browser viewing a page. Other cases make similar distinctions.

 

They just tell you where the orginal file is in the youtube's site. They don't host any file. It is just a cool script man.

Icon, just the mere act of using copyrighted materials (except a few cases) is illegal, you don' thave to change anything or redistribute it.

 

As far as i know their not beaking any laws, if the video is copyright then it shouldn't be on youtube anyway unless issued by it's owner.

 

Pretty much all videos are copyrighted from the moment they are made, save for press releases created by the company and a couple other special incidences. Copyright is created the moment the intellectual property is created.
