Hey, I'm not sure if this is the right forum for this but I am planning to buy a domain for which I plan to develop a gaming community with that is based around a game that I am addicted to. I plan to use the game name in the domain so would that be an issue with the trademarks for it? Since I'm using the website as a forum to help others with missions and just help them out in general. Thanks
The answer to your question is not easy because the law is ambiguous in this area. For example, www.beaniebabies.com can only be used by the Beanie Baby company, but a court said that www.bargainbeanies.com could be used by a reseller of used Beanie Babies under certain conditions. Without any hints of commercial use, especially ads, that can work. However, be aware the mark holder in question can still dispute it if they feel like it, and it'll then depend if you wish to fight for it or not. While one can think that can benefit them, that's for the mark holder to think and decide on their own.
Yeah, you need to be careful with this. As Dave said, it will largely depend upon whether or not the trademark holder wants to come after you. If they do, you might have a decent case to fight, but it would still be costly.
