Is there a way to SUE payal?

    Hello,
    Today paypal totally pissed me off when it charged me unfair 11 $ resolution dispute issue and would like to sue paypal if possible.
    Here is in brief what happened :

    1 year back on jan 22 2005 i bought some item of ebay and it never arrived and i opened a chargeback case and as a result i lost 83$ cause the other user ran away probably with the money, so i let it go thinking ok maybe one day i will get it back. But today some one did charge back of 1.50$ and i was forced to pay freaking 12$ to paypal as chargeback fee, plus whats more disgusting is that 1 month back i transferred 250$ to my bank and that money never arrived in my bank, and i feel that paypal has crossed its limit and its time to either sue them or get back all my money back. So anyone here has contact or works with paypal to settle this outside of court and if i do have to go to court what sort of case should be filled and is it worth or paypal just too big a fish to fry?:eek:

    The total loss u incurred is not more than 400$ ....
    and your spending on the hearing sure is gonna be more than this!
    Plus there is no assurance you will get your money back ...
    So better stay chill and use someother payment processor if paypal doesnt work out for you!

    I have lost more then 3265 till now and as I am talking I think Some more scammer will be purchasing my products with Fraud CC's

    But still I am not sueing paypal. I don't know why. :D

    Hmm maybe we can hire a lawyer together and get others like us burned by paypal to sue their sorry asses finally.

    I think u have to be burned by paypal to be in but if u would like to pay for the lawyer fees sure ur in :cool:

    Hmm..

    Im more for a pro bono kind of thing.. There must be some corporate legslative lawyer out there.. With a violent grudge for Paypal..

    But seriously.. how should the charge be put.. We have all said yes to their TOS upon sign up.. Hard to prosecute on that basis :(

    Ok what about on moral grounds cant we sue them on that? Cause i dont see why they charged me chargeback fee even when they still owe me 83 bucks they could have just deducted thatfee from that amount, maybe its time for us to charge paypal a fee on moral ground or mental tension it gives us.

    Well, I got charged several times chargeback fees by Paypal. I own dating websites and a lot of nigerian scammers used stolen credit cards to purchase premium membership on my sites so they can send their scam messages to my members.

    They use these stolen credit cards to open paypal accounts. Even though, paypal should be more careful and not allow this, I am the one who end up paying the chargeback fees.

    You can sue for just about anything. But for 11 bucks? I would just chalk it up to a "cost of doing business" and move on. When you start seeing charge backs for $2500 for services rendered 6 months after the fact, then I would take some type of action. You really have to expect some of these pitfals. Again, it is just a cost of doing business.

    That is what i am talking about, i think paypal has no right to charge the person paying back but it should be the person getting money back its not buyers responsiblity who they sell stuff to but its clients responsiblity to keep their credit cards secure and not pay for services they do not want.

    If you guys can get positioning on the keywords PayPal Lawsuit...talk to me...I work with lawyers that will represent you as a "class" if there is a trend of PayPal thinking $10 here $20 there isn't worth paying.

    Keep in mind, there is no up front fee but you need to have a legit case and you need to get a large group of people with same issue's together in order to form a class.

    Upon further investigation of PayPal's resolution dispute charges...my conclusion is that you need to use another service if you don't like PayPals Terms of Service. It is in the contract that you agreed to...you’d be paying more if you had a merchant account...and you are pretty much just whining about someone else profiting from their product. Get over it...move on.

    Good luck...I am not interested in pursuing this matter anymore.

    I researched this and you can see my later post indicating that this is a frivilous complaint that I have no desire in pursuing....big business walks all over people that are scared to stand up to them.
