1. We are not fully happy with your reply number ONE: "I will send you an email if that happens, i usually don't close accounts at the first problem. I will give you a 2nd chance if that happens."

We asked whose account will be suspended/terminated (master reseller. reseller, sub-reseller or customer) in case a website creates problems and violates ToS/AUP?

2. You neither provided us URL of your website and ToS. The reply which you have given is mostly given by scammers (we believe you are not one of those )

3. What is th backup frequency and will you provide backup in case it is required free of cost?

4. What is your server IP and its full details as well as location, please?

5. You have PHP 4 and 5 installed - few querries:
- what is the position of open base_dir restriction?
- what is the position of php safe_mode?
- what is the position of cron.deny file? Is it there?
- how much RAM is allowed to php?
- cURL, mCrypt, OpenSSL and GD compiled into PHP?
These are required to run ClientEXEC billing and support software.

6. Will you provide the paths for csh and bas as these are required by my php script named 'server status'? This is 100% safe and secure script and if you feel it is violating the ToS we will pay all the penalties.

Wow! There's a lot of questions to answer as a HOST

Normally I don't bother to ask all that coz not sure what is it

Just look at the plan and buy it then later comes troubles

And even the host guy can't fix the problems instantly

Anyway I like to sell hosting and I like this plan

 

Why not to answer all these questions here itself so every one can trust your services and plans ?

 

Not as a HOST, as a service provider

All these questions are related to legal issues. Actually all these issues must be clearly stated on the service providers on their websites as per international cyber laws.

There are few laws which are amusing, e.g.
1. 'web hosting accounts cannot be suspended/terminated by the service provider whatsoever is the fault of webmaster'. Service provider has to appraoch the court of law in case it is spamming, mass mailing or running bad scripts instead suspending/terminating the account himself.
2. 'services cannot be denied'. Service provider has to clearly state what he is NOT providing, rest is assumed by court of law as 'provided' If something is not provided it should be marked on 'website' itself as 'NOT AVAILABLE'.
3. Most interesting is that any ToS/AUP is not a legal document internationally in the court of law. Whatsoever we have written in ToS/AUP has no value in the court.
4. Web hosting MUST not be provided on an un-registered domain

Does any one care all these laws? It results in bad test, disappearing act and scamming.

We are in business since 1998 and we hired legal services at very nominal cost in India and USA to avoid issues because mostly service providers disappear when there is a real legal issue. We had few issues with Yahoo and Google and to resolve them we decided finally to hire legal services permanently on yearly contract basis. We work as per the advice of legal assistance and carefully follow cyber laws. You can notice that not only we registered all our websites but we trademark them also.

All that is just for your info and to general webmasters and to service providers related to webhosting and domain name registrations.
