Selling Email Database is Legal !!!

Dear Member ! I have a database of 500 k (USA) email list.

I decided to sell them as soon as possible.

but I afried that this is a legal thing or not if it is legal please know

me. I want to sell imidialtely.

What is the source of the email addresses? Were people who signed up for the list told that their addresses could be shared or sold? Did they sign up after reading sales copy that suggested they would only be receiving emails from you? What are the circumstances?

 

I do not have any source I dont know anything, dont have their name or IP address. but I knwo they are form USA.

 

You must have the user's permission before doing this. many website put a notice to the user that there email migh be used with other 3rd parties, so think before you make this move, maybe talk to a laywer or read about it on the net.

 

You really should have a disclosure, or this may tread the thin line of the Can-Spam Act...If it's not a legal issue, it's a moral issue -- Would you appreciate your email being sold when you assumed it would not be?

Are all the email address "Opt-In", or are they just inadvertently gathered or "collected"?

 

If you don't know the source of the emails, I fail to see how you can use them legally. As far as you know, none of the people authorized their email to be on some list. Using it, after acknowledging you don't know its source, would be folly.

 

If there are any from Europe then you should have gotten their explicit consent and simply agreeing to general T&Cs is technically not sufficient.

Not knowing the source means they arent worth anything to a legitimate company - even if they do take them they would get you to indemnify them for damages caused if it did turn out they were not appropriately sourced.

it depends what country you live in and its data protection laws

for example in the uk you can only export the data (if it was obtained there) to a country with equiv data protection laws

 

if they had agreed that you can sell it then it's legal otherwise it can land you in problem

 

If you don't know how they were obtained it is not legal. To use or sell them you need to have the permission of each owner.

You obvoiusly do not have any way of proving that the owner gave permission.

 

Would it be legal to sell these? Perhaps.

Would it be legal to e-mail these people? Not in most western countries.

 

If I had the database to sell, I probably wouldn't. I would ask myself if this is something that I would buy, and since it isn't, it is probably not something I want to associate with myself.

 

i can not take 500 k peoples permissons, and you are bannded form DP..dont need to talk laywer about it.

 

Do not try to put yourself in the trouble hole. If you are sued by law for selling 500 k your reputation sucks and you can not do transaction easily as before.
