If nintendo wanted , they could take control of that name, and if its specific marketing they are after , they would, but your best option would be to sell it on to another company.

so what if you used a hotel name like hilton and had a domain like
hollywood-hilton.com would this be considered trademarked?

I also doubt you would get any of the PPC companies like overture or google to accept ads to it.

Why would someone want it if it has legal issues?

I would have just sold it on for $1000 , a search engine company would love that domain.

Who would buy it? I don't understand why someone would pay to get into legal issues.

I once had gamecube.cc and they did nothing. But when I registered nintendohq.com, then I got the E-mail and USMail notice from them (I ignored them and let the domain expire.)!!! I've had another domain with the name 'nintendo' in it since 1996 and another one since 1999 and they never contacted me about them, though I know they have visited my sites, as they once contacted one of my message board users after posting a link to a ROM.
